To protect the integrity of the MulderCreations Registry, each Registered Owner is identified and verified before ownership is officially registered.

Verification status
An identification document may be inspected or used during the verification process. MulderCreations does not, as a standard procedure, retain a complete copy of an identification document after verification unless retention is required by law or is otherwise legally necessary.

A Registered Owner may choose to be displayed publicly under their own name, a verified alias, or as private. The underlying Registered Ownership remains verified by MulderCreations regardless of the chosen public display option

Legal and Wwft Compliance
Where required by Dutch law, including the Dutch Anti-Money Laundering and Anti-Terrorist Financing Act (Wwft), MulderCreations may be required to conduct additional client due diligence.
Depending on the circumstances, this may include information necessary to establish:

Whether a person acts on their own behalf or on behalf of another person or organisation

The authority of a representative to act for a company or other legal entity

The identity of the Ultimate Beneficial Owner (UBO), where applicable

4. Legal Basis for Processing
Depending on the purpose, MulderCreations processes personal data on one or more of the following legal bases:

Performance of a contract: where processing is necessary to complete a purchase, delivery, registration or ownership transfer.

Legal obligation: where MulderCreations is required to retain or process information under tax, accounting, Wwft or other applicable law.

Legitimate interests: where processing is necessary to protect the integrity, security, authenticity and provenance of MulderCreations artworks and the Registry, provided that these interests do not override the fundamental rights and freedoms of the individual.

MulderCreations only shares personal data where necessary for its services, Registry operations or legal obligations.
Depending on the circumstances, data may be shared with:

Only the information necessary for the relevant service or purpose will be shared.
Where required, appropriate agreements and safeguards are used to protect personal data processed by third-party service providers.
6. Data Retention
MulderCreations does not retain all categories of personal data for the same period.
Financial and Transaction Records
Financial and administrative records are retained for the period required under applicable Dutch tax and accounting legislation.
Identity Verification and Wwft Records
Identity verification information is retained only for as long as necessary for its purpose or for the period required by applicable law.
Where information is processed as part of a legally required Wwft client due diligence procedure, the applicable statutory retention period will be observed.
Complete copies of identification documents are not retained as a standard part of the MulderCreations Registry.
Registry and Provenance Records
The purpose of the MulderCreations Registry is to maintain a continuous historical record of each individual edition throughout its existence.
For this reason, information forming part of the permanent provenance and ownership history — including ownership periods, verified transfers, transaction dates, sale prices and significant provenance events — may be retained on a long-term or permanent basis where this is necessary to preserve the integrity and historical accuracy of the Registry.
Sensitive underlying verification information is treated separately from the permanent provenance record and is not retained indefinitely merely because the provenance record itself is permanent.
Enquiries and General Correspondence
General enquiries and related correspondence are retained only for as long as reasonably necessary for the purpose for which they were received, unless longer retention is necessary because of an ongoing collector relationship, transaction, dispute or legal obligation.
7. Public Registry Information
Certain information relating to an artwork may be displayed publicly as part of the MulderCreations Registry.
This may include:

Public ownership status
Registered Owners can choose whether their identity is publicly displayed under their own name, through a verified alias, or as private.
Personal identification documents, private contact details and underlying identity-verification information are not displayed publicly.
8. Security
MulderCreations takes appropriate technical and organisational measures to protect personal data against loss, unauthorised access, alteration, disclosure or misuse.
Identity-verification information and other non-public personal data are treated separately from publicly accessible Registry information and access is limited to those who require it for legitimate operational, verification or legal purposes.
9. Your Rights
Under the GDPR, depending on the circumstances, you may have the right to:

A request to delete personal data does not automatically result in the deletion or rewriting of factual historical provenance or transaction records where MulderCreations has a lawful basis for preserving those records.

Because MulderCreations operates internationally and may use service providers located in different countries, personal data may in certain circumstances be processed outside the European Economic Area.

MulderCreations may update this Privacy Policy when its services, Registry, technology or legal obligations change.
